1. Who We Are

This Privacy Policy (the “Policy”) is issued by Bud’s Goods & Provisions Corp (“Bud’s Goods,”), with a principal place of business located at 54 West Boylston Street, Suite 1, Worcester, MA 01606, and describes how we collect, use, share, and protect personal information in connection with www.budsgoods.com (the “Website”) and our recreational (adult-use) retail stores. Bud’s Goods does not offer a delivery service. This Policy should be read together with our Terms of Use.

2. Use by Persons Under 21 Is Prohibited

Bud’s Goods is a recreational (adult-use) retailer only. Our Services are intended only for adults 21 years of age or older. Bud’s Goods does not knowingly collect personal information from anyone under 21.  Data accidentally collected from individuals under the age of 21 will be deleted as soon as administratively possible.

3. Information We Collect

Information you provide to us:

  • Contact and account information, such as your name, email address, phone number, mailing address, and username;
  • Age and identity verification information, including a government-issued photo ID and date of birth, collected in-store at the point of sale as required by Massachusetts Cannabis Control Commission regulations;
  • Order and payment information, such as the products you purchase, transaction amount, and payment method;
  • Marketing preferences, when you opt in to email or SMS communications;
  • Communications you send us, such as customer service inquiries; and
  • Rewards or loyalty program information, if you enroll.

Information collected automatically:

  • Device and usage data, such as IP address, browser type, pages viewed, and referring URLs;
  • Cookies and similar tracking technologies, described in Section 6 below.

Information from other sources:

  • Information reported to or received from the Massachusetts seed-to-sale tracking system as required for regulatory compliance;
  • Information from marketing or referral partners, where applicable.

In-store security and video:

Bud’s Goods retail locations use video surveillance for security and as required under Massachusetts Cannabis Control Commission regulations. Footage may be shared with law enforcement or regulators in response to valid legal process.

4. How We Use Your Information

  • To verify your age and eligibility and comply with Massachusetts Cannabis Control Commission recordkeeping and seed-to-sale reporting requirements;
  • To process and fulfill in-store orders and payments;
  • To provide customer service and respond to your inquiries;
  • To send Service Messages, including order confirmations and legally required notices, which you cannot opt out of;
  • To send marketing communications where you have opted in, which you may opt out of at any time;
  • To administer our Rewards/loyalty program, if you enroll;
  • To maintain store security and help prevent fraud;
  • To operate, maintain, and improve the Website; and
  • To comply with the law, respond to legal process, and protect the rights, property, and safety of Bud’s Goods, our customers, and others.

5. Cookies & Tracking Technologies

The Website uses cookies and similar tracking technologies in the following categories:

  • Strictly Necessary — required for the Website to function, such as maintaining your session or shopping cart;
  • Performance/Analytics — help us understand how visitors use the Website so we can improve it;
  • Functionality — remember choices you make, such as language or store location preferences;
  • Advertising/Targeting — used to show you more relevant advertising and measure its effectiveness.

Where legally required, we use a cookie-consent tool that lets you accept or reject non-essential cookies before they are placed on your device. We do not currently respond to browser “Do Not Track” signals.

California visitors: by using the Website, you consent to our use of the tracking technologies described in this Section, including any electronic pen register, trap and trace device, or similar technology used for site analytics, to the extent applicable under California Penal Code § 638.51 or a similar law. You may withdraw consent at any time by adjusting your preferences in our cookie-consent tool.

6. How We Share Your Information

  • Service providers who help us operate the business, such as IT hosting, payment processing, our e-commerce/point-of-sale platform, and marketing or SMS platforms, under confidentiality and data-protection obligations;
  • Regulators, including the Massachusetts Cannabis Control Commission and the state seed-to-sale tracking system, as legally required;
  • Law enforcement, courts, and government agencies, when required by law or to protect the safety or rights of any person;
  • A successor business, in connection with a merger, acquisition, or sale of assets; and
  • Any other party, at your direction (for example, if you make a referral).

Bud’s Goods does not sell your personal information for money. Some sharing of information with advertising or analytics partners for interest-based advertising could be considered a “sale” or “share” under privacy laws of certain other states. Massachusetts does not currently have a comprehensive consumer privacy law of this kind (see Section 10 below), but we will update this Policy and provide an opt-out mechanism if and when Massachusetts law requires it.

7. Data Retention

  • Compliance and transaction records are retained for the period required under Massachusetts Cannabis Control Commission recordkeeping regulations;
  • Marketing data is retained until you opt out or request deletion;
  • Account data is retained while your account is active, plus a reasonable period afterward for legal and business purposes; and
  • Security footage is retained as described in Section 3 above.

8. Data Breach Notification

If Bud’s Goods experiences a breach of security involving your unencrypted personal information that creates a substantial risk of identity theft or fraud, we will notify affected Massachusetts residents, the Massachusetts Attorney General, and the Massachusetts Office of Consumer Affairs and Business Regulation as soon as practicable and without unreasonable delay, consistent with our obligations under M.G.L. c. 93H. Notice will describe, to the extent known, the nature of the breach, the categories of information involved, and steps you can take to protect yourself.

9. How We Protect Your Information

We maintain administrative, technical, and physical safeguards designed to protect personal information, consistent with the Massachusetts Standards for the Protection of Personal Information (201 CMR 17.00). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your Privacy Choices & Rights

Massachusetts does not currently have a comprehensive consumer privacy law comparable to California’s. As a matter of practice, however, we offer all customers the ability to: request access to the personal information we hold about you; request correction of inaccurate information; request deletion of your personal information, subject to our regulatory recordkeeping obligations; and opt out of marketing communications at any time. To exercise any of these choices, contact privacy@budsgoods.com; we will respond within a reasonable time.

11. Children’s Privacy

Our Services are intended only for adults 21 years of age or older. We do not knowingly collect personal information from anyone under 21, and if we learn that we have, we will delete it.

12. Third-Party Links

The Website may link to third-party websites. We are not responsible for the privacy practices of those sites and encourage you to review their policies before providing them with information.We may use automated processes to analyze information about you, such as your interactions with our services, purchase history, preferences, and engagement with our marketing communications, to segment customers and personalize or target marketing communications, offers, and promotions.
These activities are used for marketing and customer engagement purposes and do not produce legal or similarly significant effects concerning you. We do not currently use automated decision-making that produces legal or similarly significant effects concerning you.

13. Automated Decision-Making

We may use automated processes to analyze information about you, such as your interactions with our services, purchase history, preferences, and engagement with our marketing communications, to segment customers and personalize or target marketing communications, offers, and promotions.
These activities are used for marketing and customer engagement purposes and do not produce legal or similarly significant effects concerning you. We do not currently use automated decision-making that produces legal or similarly significant effects concerning you.

14. Industry Regulatory Disclosure

As a Massachusetts-licensed Marijuana Establishment, Bud’s Goods is subject to the recordkeeping, seed-to-sale tracking, advertising, and security regulations of the Massachusetts Cannabis Control Commission under 935 CMR 500.000, and to applicable requirements of M.G.L. c. 94G and c. 94I. Certain personal and transactional information is reported to state regulators as required by law.

We may update this Privacy Policy from time to time. We will post the revised Policy on this page and update the “Last Updated” date above.
